Tribal courts lack power over non-Indian abusers-Matthew CE

In the article they talked about the lack of power in the court system.

In the article there is an event that the Reservation feels that they should be able to handle but federal courts say no.


What do you think that the court should do regarding handling altercations on and off of the ?

  1. I think that both courts should be mixed, because then it would all be fair by having Indians and Americans mixed in the court room. Also if we used the Indian courts that are in place and inter graded it into the american court systems then we now how some more courts to help fix the back log issues.

  2. I agree with Amiee because everyone should have a fair trial, and if its mixed then certain people wont be favored over the other or something like that. If someone is non Indian it really shouldn't matter. They definitely need to be prosecuted, thats the whole point of mixed court systems. That just means that this person is probably gonna get off with no charges or anything and chances are it will happen again but the court doesn't have enough power to do anything about it because he is not Indian. Thats not fair to people on the reservation.

  3. I think that the court should b mixed of all residence of that states. It doesnt matter where they live because they still are apart of that state and it doesnt matter whether they are indian or american. They are still effected by the decisions made by the government.

  4. I think that if a crime occurs on a reservation, then the tribal courts shoulb be able to handle the case so they are given some power in the court system.

  5. I agree with jd. If a crime happens on a reservation no matter what race they are they should be able to prosecute them. I don't understand how if an american breaks a law in another country that country can prosecute them. But on a reservation they can prosecute them. It doesn't make sense that we are letting this happen.

  6. i agree with Aimee. i think that the court should me mixed. Its not fair if they favor one off them. they all should t a equal share. they should be prosecuted because if they were not then there would be no point for the court.

  7. I think the tribal courts should be able to handle all crimes on the reservations but state courts should handle crimes off the reservations. This is the most fair compromise which makes the most sence.

  8. I think that it should be mixed because it does not matter if the person in American or Native American; they should be treated as equals.

  9. I think tribal courts should handle matter regarding crimes commited on the reservation. However, if a crime is comiitted off the reservation by a member from the reservation i believe the tribal court should have a say. State courts should deal with matters off the reservation.

  10. I believe that tribal courts should always handle the courts that involve crimes on the rez. If they start bringing in the federal courts then controversy will come into play.

  11. I think they should mix it from people both on and off the reservations especially if they come from off the reservations.
